Fines under 100 BGN shall not be appealed

The new Administrative-penal code foresees that fines smaller than 100 BGN shall no longer be appealed in court. It is being prepared by the Ministry of Justice.

 

In the present conditions you cannot appeal against a sanction for 10 BGN and judges complain that they are overloaded with great amounts of claims for minimal monetary fines. A lot of the Bulgarian institutions and departments can fine administrative sanctions - Ministry of Interior, the municipalities, the National Revenue agency, Customs, etc.

 

The new code shall replace the Administrative violation and punishment act which has been amended multiple times since its coming into force in 1969. The code entries a new penalty for administrative violation - detention up to 30 days in the police arrest along with socially useful work. Temporary deprivation of practicing profession or activity, fine and social reprobation are the rest of the administrative penalties for physical persons. Juridical persons and sole proprietors shall be inflicted with real property sanctions.
